Section 52: Contract Review and Signature
52.1 Clickwrap or "Click to Accept" Contracts
(1) Clickwrap or “click to accept” contracts are contracts as defined by Policy 528, Contract Signature Authority and Delegation.
(2) Employees of Utah State University may accept terms and conditions within a clickwrap or “click to accept” contract. The terms and conditions of the contract should be read carefully. If there are any questions about the terms and conditions please contact Purchasing and Contract Services prior to accepting the terms and conditions.
(3) It is recommended that clickwrap or “click to accept” contracts be printed and routed for review following standard University contract review procedures if any of the following apply.
(A) The employee of Utah State University does not understand the terms and conditions.
(B) The contract is for a multi-user software license.
(C) The contract includes any terms and conditions related to FERPA, FSA, HIPAA, Personally Identifiable Information (PII), PCI DSS, or other security language prescribed for the protection of information or a particular data set.
(4) Colleges or Departments may establish rules and procedures that require clickwrap or “click to accept” contracts be printed and routed for review following standard University contract review procedures. Purchasing and Contract Services will support Colleges and Departments that establish these rules and procedures.
